1. Acceptance of Terms

By accessing or using BasedHosting services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

BasedHosting provides the following hosting services:

• VPS Hosting: Virtual Private Server hosting with root access
• Discord Bot Hosting: Specialized hosting for Discord bots and applications
• Dedicated Servers: Physical server hosting with full hardware control
• Web Hosting: Shared and managed web hosting solutions
• DDoS Protection: Network security and attack mitigation services

All services are provided "as is" and we reserve the right to modify, suspend, or discontinue any service at any time.

3. Prohibited Activities

Illegal Content and Activities

• Hosting, distributing, or promoting illegal content of any kind
• Copyright infringement, piracy, or intellectual property violations
• Child exploitation material or any content involving minors
• Terrorist content, extremist material, or hate speech
• Drug trafficking, weapons sales, or other illegal commerce
• Money laundering, fraud, or financial crimes
• Identity theft or personal information harvesting

Network Security Violations

• DDoS Attacks: Launching, coordinating, or participating in Distributed Denial of Service attacks
• Network Scanning: Unauthorized port scanning, vulnerability scanning, or network reconnaissance
• Penetration Testing: Testing security of third-party systems without explicit permission
• Botnet Operations: Creating, operating, or participating in botnets
• Malware Distribution: Hosting, distributing, or creating malicious software
• Phishing: Creating fake websites or services to steal credentials
• Spam Operations: Mass unsolicited email distribution or spam hosting

Abuse of Our Infrastructure

• Resource Abuse: Excessive CPU, memory, or bandwidth usage that affects other users
• Mining Operations: Cryptocurrency mining without explicit permission
• Proxy/VPN Abuse: Operating open proxies or VPN services for malicious purposes
• Traffic Amplification: Using our services to amplify network attacks
• Service Testing: Using our infrastructure to test DDoS protection or security systems

Hacking and Unauthorized Access

• Attempting to gain unauthorized access to any system, network, or account
• Brute force attacks against authentication systems
• Exploiting vulnerabilities in third-party systems
• Social engineering attacks or credential harvesting
• Reverse engineering or circumventing security measures

4. Account Responsibilities

Account Security

• You are responsible for maintaining the security of your account credentials
• Use strong, unique passwords and enable two-factor authentication
• Immediately report any unauthorized access or security breaches
• Do not share account credentials with unauthorized parties

Content Responsibility

• You are solely responsible for all content hosted on your services
• Ensure all content complies with applicable laws and regulations
• Maintain proper backups of your data and applications
• Monitor your services for unauthorized access or malicious activity

Resource Usage

• Use resources fairly and in accordance with your service plan
• Do not exceed allocated bandwidth, storage, or processing limits
• Optimize applications for efficient resource utilization
• Report any unusual resource consumption immediately

5. Service Level Agreement (SLA)

Uptime Guarantee

• VPS/Dedicated Servers: 99.9% uptime guarantee
• Discord Bot Hosting: 99.5% uptime guarantee
• Web Hosting: 99.9% uptime guarantee

Maintenance Windows

• Scheduled maintenance will be announced 48 hours in advance
• Emergency maintenance may be performed without notice
• Maintenance windows are excluded from uptime calculations

Support Response Times

• Critical Issues: 1 hour response time
• High Priority: 4 hour response time
• Normal Priority: 24 hour response time
• Low Priority: 72 hour response time

6. Payment Terms

Billing

• Services are billed in advance on a monthly or annual basis
• Payments are due within 7 days of invoice generation
• Late payments may result in service suspension
• All prices are exclusive of applicable taxes

Refunds

• New customers are eligible for a 7-day money-back guarantee
• Refunds are prorated for unused service periods
• Setup fees and domain registrations are non-refundable
• Refunds for terms of service violations are not provided

Service Suspension

• Services may be suspended for non-payment after 7 days
• Data may be deleted after 30 days of suspension
• Reactivation fees may apply for suspended services

7. Data Protection and Privacy

• We process personal data in accordance with our Privacy Policy
• Customer data remains the property of the customer
• We implement appropriate technical and organizational security measures
• Data breaches will be reported in accordance with GDPR requirements
• Customers are responsible for their own data backup and recovery

8. Limitation of Liability

To the maximum extent permitted by law:

• BasedHosting shall not be liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid for services in the preceding 12 months
• We are not responsible for data loss, business interruption, or lost profits
• Force majeure events are excluded from liability
• Third-party service failures are not our responsibility

9. Termination

Termination by Customer

• You may terminate services at any time with 30 days notice
• Prepaid amounts will be refunded on a prorated basis
• Data export must be completed before termination

Termination by BasedHosting

• We may terminate services immediately for terms of service violations
• 30 days notice will be provided for non-violation terminations
• No refunds are provided for violation-based terminations
• We reserve the right to retain data for legal compliance

Effect of Termination

• All services will be immediately suspended upon termination
• Data will be deleted within 30 days unless otherwise requested
• Outstanding invoices remain due and payable
• Confidentiality obligations survive termination

10. Dispute Resolution

Governing Law

These terms are governed by the laws of [Your Jurisdiction] without regard to conflict of law principles.

Dispute Process

• Disputes should first be addressed through our support system
• Mediation will be attempted before formal legal proceedings

12. Fair Usage Policy & Staff Authority

Fair Usage Policy

All services are subject to our Fair Usage Policy, which ensures optimal performance and availability for all customers:

• Resource Limitations: Services marked as "unlimited" are subject to fair usage restrictions
• Bandwidth Usage: Excessive bandwidth consumption that impacts network performance is prohibited
• CPU and Memory: Sustained high resource usage that affects other customers may result in service limitations
• Storage Usage: Abuse of storage resources, including backup services, is not permitted
• Network Abuse: Any activity that degrades network performance or availability is strictly forbidden

Staff Authority and Service Management

• Immediate Termination: Staff may terminate services immediately without prior notice if deemed necessary
• No Refund Obligation: BasedHosting is not obligated to provide refunds for terminated services, regardless of the reason
• No Explanation Required: Staff is not required to provide detailed explanations for service termination decisions
• Final Decision: All staff decisions regarding service termination are final and non-appealable
• Data Removal: Upon termination, all data may be immediately and permanently deleted without recovery options
• Account Suspension: Accounts may be suspended pending investigation without compensation

Enforcement

• Fair usage violations will be monitored continuously through automated systems
• Staff decisions are based on technical analysis and operational requirements
• No appeals process is available for staff decisions
• Alternative dispute resolution does not apply to staff authority decisions

13. Miscellaneous

Entire Agreement

These terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and BasedHosting.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Assignment

You may not assign your rights or obligations under these terms without our written consent. We may assign our rights and obligations at any time.

Waiver

Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
